Terms of Service

1. Services

SELLING4D provides digital twin development, 3D scanning, LiDAR capture, drone photography, and related services as described on our website. Services are subject to availability and mutually agreed-upon project specifications outlined in individual service agreements or statements of work.

2. Client Responsibilities

Clients agree to:

• Provide accurate project requirements and site access information
• Ensure safe site conditions and necessary permissions for data capture
• Respond to requests for feedback and approvals in a timely manner
• Make payments according to agreed-upon terms
• Maintain confidentiality of any proprietary processes or methods shared during service delivery

3. Intellectual Property

Upon full payment, clients receive ownership rights to the final deliverables as specified in the service agreement. SELLING4D retains the right to use non-confidential project work in our portfolio and marketing materials unless otherwise agreed in writing. All underlying methodologies, software, and processes remain the property of SELLING4D.

4. Payment Terms

Project pricing is established in individual quotes or service agreements. Standard payment terms include a deposit upon project commencement and final payment upon delivery. Prices are subject to adjustment if project scope changes significantly from the original agreement.

5. Warranties and Limitations

SELLING4D warrants that services will be performed in a professional manner consistent with industry standards. Digital twins and 3D models are representations based on captured data and may have tolerances specified in project documentation. We are not liable for decisions made based on digital twins without appropriate engineering verification.

6. Confidentiality

Both parties agree to maintain confidentiality of proprietary information shared during projects. NDAs are available upon request for sensitive projects. Project data is stored securely and access is limited to authorized personnel.

7. Cancellation

Project cancellations must be provided in writing. Cancellation fees may apply based on work completed and resources committed. Deposits are non-refundable after work has commenced.

8. Limitation of Liability

SELLING4D's liability is limited to the fees paid for the specific service in question. We are not liable for indirect, incidental, or consequential damages arising from the use of our services or deliverables.

9. Governing Law

These terms are governed by the laws of the State of Florida. Any disputes will be resolved in the courts of Flagler County, Florida.
